7th December, 1938.
I have the honour to inform you that representations
have recently been made on behalf of the Hong Kong and Shanghai
Banking Corporation that they are desirous of becoming a trust
company under the Trustee Ordinance of 1934. It is thought
undesirable in principle that such status should be conferred
on the Hong Kong and Shanghai Banking Corporation individually,
and I consider that it would be preferable that the Ordinance
should be amended in general terms so as to permit them to
proceed under it.
2.
The draft of a bill, a copy of which I enclose for
consideration, has therefore been prepared in consultation with
the Bank's solicitors, empowering the Governor-in-Council to
grant the status of a Trust Company, subject to certain
conditions, to any banking corporation.
3.
In view of the provisions of Article XXVI (4) of the Royal Instructions, I shall be glad to receive your approval of the bill before its introduction into Legislative Council.
